Customer Terms & Conditions

Welcome to Cyndtek! The following terms govern the sale of products (“Products”) and services (“Services”) provided by Cyndtek and its affiliates (“Seller”). By purchasing from Cyndtek, you agree to these terms. Please review them carefully.

Acceptance of Orders

All orders are subject to approval by Cyndtek. Orders may not be canceled or rescheduled without written authorization. Certain products are designated as non-cancellable and non-returnable (“NCNR”). These NCNR terms supersede any conflicting provisions listed elsewhere.

Pricing & Taxes

Pricing: Product prices are those shown on the invoice at the time of purchase. Prices for unshipped products may be adjusted due to market conditions.
Quote Expiration: All price quotations expire after 10 business days unless otherwise stated.
Taxes & Fees: Prices exclude shipping, handling, insurance, and taxes. Buyers are responsible for all applicable federal, state, and local taxes unless a valid exemption certificate is submitted with each tax-exempt order.

Payment Terms

Payment is due within 30 days of the invoice date unless otherwise specified. Late payments are subject to a 1.5% monthly finance charge. Cyndtek reserves the right to modify payment terms based on financial standing or payment history. Buyers are responsible for all past-due balances and collection-related fees if applicable.

Shipping & Delivery

Shipping Terms: All products are shipped EXW (Ex Works) from Cyndtek’s facility. Title and risk transfer to the buyer once the carrier receives the shipment.
Delivery Estimates: While delivery timelines are estimated in good faith, they are not guaranteed. Cyndtek is not liable for delays caused by carriers, natural events, or external disruptions.

Warranty & Liability

Manufacturer Warranty: Any warranties from the original manufacturer will be passed through to the buyer.
Limited Warranty: Cyndtek provides a one-year limited warranty from the date of delivery. If a product is deemed defective, Cyndtek may choose to repair, replace, or issue a refund. Liability is limited to the original purchase price.
No Indirect Liability: Cyndtek will not be held liable for indirect, incidental, or consequential damages, including lost revenue or business interruption.

Returns & Cancellations

Return Policy: Eligible products may be returned within 15 calendar days from the order’s completion date. All return requests must be initiated by the customer through their Cyndtek account.
To request a return:

1. Log in to your account at cyndtek.com

2. Go to My Account > Orders

3. Click “Request Return” next to the appropriate order

Returns must be authorized by Cyndtek. Once approved, a prepaid return label will be issued. Products must be returned in their original packaging and must meet any applicable minimum quantity requirements.

Refunds: Refunds are processed only after the returned items have been received and approved. Shipping charges are non-refundable unless the return is due to a Cyndtek error.

NCNR Products: Items marked as non-cancellable and non-returnable are not eligible for return or refund under any circumstances.

Shortages, Errors, & Damages

Claims for shortages, shipment errors, or physical damage must be reported within 10 days of delivery. Returns without prior authorization (RMA) will not be accepted.

Export Compliance

Buyers are responsible for adhering to all applicable import and export laws, including U.S. export control regulations. Products must not be re-exported to restricted countries or entities.

Use of Products

Cyndtek’s products are not certified for use in life-support, medical, or nuclear applications. If used in such environments, the buyer assumes all responsibility and agrees to indemnify Cyndtek and the manufacturer against any resulting claims.

Intellectual Property

Any software or intellectual property accompanying products is governed by its respective license. Cyndtek disclaims ownership over third-party intellectual property rights associated with distributed products.

Force Majeure

Cyndtek is not liable for failure to perform due to causes beyond its control, including natural disasters, labor disruptions, or governmental restrictions. Delivery dates may be extended under such conditions.

Entire Agreement

These terms constitute the complete agreement between Cyndtek and the buyer. No additional terms shall apply unless agreed to in writing by both parties. These conditions override any conflicting terms in purchase orders or correspondence.
